  • Errors in your order.
  • Suspected fraud or unauthorized transactions.

Pricing: Prices for our products are subject to change without notice. Prices displayed do not include taxes or shipping and handling charges, which will be added to your total order price during the checkout process.
Billing: By providing a credit card or other payment method accepted by us, you represent and warrant that you are authorized to use that payment method and authorize us (or our third-party payment processor) to charge your payment method for the total amount of your order.

4. SHIPPING AND RETURNS

Shipping times and delivery dates are estimates only and cannot be guaranteed. Risk of loss and title for items purchased pass to you upon our delivery of the items to the carrier.

5. INTELLECTUAL PROPERTY

Unless otherwise indicated, the Services and all content and materials therein—including, without limitation, the Panda Mali LLC logo, and all designs, text, graphics, pictures, information, data, software, sound files, and other files (collectively, "Company Content")—are the proprietary property of Panda Mali LLC or our licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-sublicensable license to access and use the Services for your personal, non-commercial use. Any use of the Services or Company Content other than as specifically authorized herein, without our prior written permission, is strictly prohibited.

6. USER CONTENT AND CONDUCT

Our Services may allow you to post reviews, comments, photos, and other content ("User Content"). You retain ownership of your User Content, but by posting it, you grant Panda Mali LLC a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

You agree that you will not post User Content that is unlawful, libelous, defamatory, obscene, pornographic, indecent, harassing, threatening, invasive of privacy, or infringing on intellectual property rights.

THE SERVICES AND ALL PRODUCTS AND SERVICES DELIVERED TO YOU THROUGH THE SERVICES ARE (EXCEPT AS EXPRESSLY STATED BY US) PROVIDED "AS IS" AND "AS AVAILABLE" FOR YOUR USE, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO the FULLEST EXTENT PERMITTED BY LAW, PANDA MALI LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

9. LIMITATION OF LIABILITY

IN NO EVENT SHALL PANDA MALI LLC, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES;
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES;
  • ANY PRODUCTS PURCHASED THROUGH THE SERVICES;
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT YOU PAID US IN THE PAST SIX MONTHS FOR THE PRODUCTS GIVING RISE TO THE CLAIM.

10. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Panda Mali LLC, its affiliates, contractors, licensors, and their respective directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.

11. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of your state, without regard to its conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms, or the breach, termination, enforcement, interpretation, or validity thereof, shall be determined by binding arbitration your state, before one arbitrator. The arbitration shall be administered by the American Arbitration Association (AAA). Judgment on the award may be entered in any court having jurisdiction.

Class Action Waiver: You and Panda Mali LLC agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

12. CHANGES TO THESE TERMS

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.

13. SEVERABILITY AND TERMINATION

If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. We reserve the right to terminate your access to the Services at any time, without notice, for any reason whatsoever.
